Topic: American with Disabilities Act Legal Update:
Enactment of the ADAAA


On September 25, 2008, President Bush signed into law the American with Disabilities Act Amendments Act of 2008 (“ADAAA”).  This legislation overturns a number of U.S. Supreme Court cases that have narrowly interpreted the American with Disabilities Act (“ADA”) and sends a message to the courts, the federal agencies charged with enforcing the ADA, and employers alike that the 1990 disability discrimination statue should be interpreted broadly.  The Act retains the ADA’s basic definition of “disability” as an impairment that substantially limits one or more major life activities, a record of such an impairment, or being regarded as having such an impairment.  However, it changes the way that these statutory terms are interpreted in several significant ways.  The ADAAA becomes effective January 1, 2009.   

Complying with ADA obligations has assumed renewed importance and requires that employers review ADA policies, procedures, and practices for compliance with this direction.  This program will examine the implication of these amendments for employers as well as best practices for ADA compliance at every stage of the hiring and employment function (hiring, medical testing, job descriptions, reasonable accommodation, leave and termination).

JEANNE M. COLACHICO

Jeanne M. Colachico heads a legal/human resources management consulting firm in North Andover, MA, Jeanne M. Colachico, Esquire & Associates, offering advice on employment matters, internal investigations, workplace assessments, general management and employment-related training, affirmative action plans, HR strategic planning and implementation, employee handbooks, and executive coaching.

Prior to 2000, Jeanne held senior legal and HR management roles for 25 years at FleetBoston Financial Group, Arthur D. Little, Textron, U.S. Department of Defense, and Massachusetts Department of the Attorney General.  

She holds a B.A. Regis College (magna cum laude), M.A. (Boston University), J.D.(Suffolk University School of Law), a Certificate, Business Administration (Babson College), and is a member of the Massachusetts Bar.  Fluent in Spanish, proficient in French and Italian, she has published numerous employment law articles, has spoken on these issues nationally, and provides training in English and Spanish.
