THIS HALF DAY PROGRAM will address recent passage of data security laws in Massachusetts and in New Hampshire.  It will also consider the impact of international data breach laws relating to workplaces outside the United States.

In today’s business environment, privacy issues and data breaches are increasingly problematic.  Data breaches are a concern to employees, employers, consumers and customers.  To comply with these new data security laws, which have onerous penalties for breach, employers must adopt internal policies regarding procedures for maintaining data privacy, for access to secured data, and for avoiding data breaches emanating from the workplace.

Employers who fail to proactively address these issues will be faced with substantial legal obligations and costs to remedy the breaches, as well as negative public exposure and loss of customer confidence.  A 2006 data breach study reported that the average cost for a data breach incident is $1 million to $22 million for correction.

This program will address the impact of data security laws affecting the workplace, focusing on the recently enacted Massachusetts Data Breach law effective May 1, 2009 and the New Hampshire Data Breach law which became effective January 1, 2007.  It will also address international data security laws which may regulate transmission of confidential data overseas, including human resources data transmitted to or from your workplaces outside the United States.

While the public may believe that the data security breaches relate to consumer credit card numbers, reports show that 90% of business record thefts involve payroll and employment records.  Further, reports show that most information thieves work from the “inside” as employees.

Employers must act now to meet the May 1, 2009 compliance date under Massachusetts law.  Because compliance may require significant operational and technological changes, employers should plan for compliance now.

Have you developed workplace policies relating to:

  1. Duties of the Chief Privacy Officer?
  2. Prohibiting use of social security numbers as identifiers?
  3. Internet use restricting employees from posting personally identifiable data?
  4. Proper classification of data?
  5. Disposing of documents properly, including electronic data?
  6. Limit employee access to confidential data and private information?
  7. Computer security for electronically store data, including use of lap tops, telecommuters’ access to data, encryption, and retention policies?

DANIEL J. BLAKE, ESQUIRE
Mr. Blake is a partner in LeClair Ryan’s Labor and Employment Group. He focuses his practice on employment counseling, litigation and labor law.

In his counseling practice, Mr. Blake works with employers to provide strategic and tactical advice on all types of employment actions, non-compete and trade secret issues, severance and employment agreements, government audits and investigations, reductions in force, employment policies, affirmative action plans and other compliance matters, as well as litigation avoidance strategies. In his litigation practice, Mr. Blake represents local and national clients before state and federal courts and agencies in all types of employment law claims including wrongful discharge, discrimination and harassment, tort claims and contractual matters. Mr. Blake also represents clients in business litigation matters.

In his labor law practice, Mr. Blake provides counsel and representation to employers in labor law matters including representation and compliance cases before the National Labor Relations Board, union relations, collective bargaining negotiations, arbitrations, union organizing campaigns, picketing, strikes and related issues. 

DEBRA DYLESKI-NAJJAR, ESQUIRE 
Ms. Dyleski-Najjar is president and founder of the Najjar Employment Law Group, PC.    She has practiced employment law for over twenty-five (25) years and is a frequent author, lecturer, counselor, and trainer on workplace issues.  She founded the Najjar Employment Law Group, PC as an employment and benefits boutique firm designed to provide top quality advice, as well as litigation expertise, for employers at reasonable rates.
She consults and advises on employment law issues; conducts investigations into alleged harassment and misconduct; drafts policies, procedures and handbooks; defends employers before state and federal courts and administrative agencies; represents executives in certain workplace situations; and otherwise assists and counsels employers on matters involving harassment, discrimination, ADA, FMLA, OSHA, ERISA, FLSA, diversity, immigration and other workplace issues.  She also drafts employment, severance, employee leasing, independent contractor and non-competition agreements, and assists employers in reductions in force and other workforce restructuring including WARN Act compliance.  Ms. Najjar also represents employers in union organizing drives, collective bargaining, and arbitrations.  She has extensive experience representing employers in litigation under ERISA including defending claims in bankruptcy relating to plan termination, and in defending claims of  fiduciary breach and claims relating to withdrawal from multi-employer pension plans.
Due to Ms. Najjar’s significant professional accomplishments, in 2007, she was nominated by her peers and inducted as a Fellow of the College of Labor and Employment Lawyers. 

 

KEITH W. SALUSTRO, CISSP
Keith Salustro, CISSP, is an information systems security professional with over twenty years of experience in Information Technology, and more than ten in Information Security. He is the founder of Security Best Practices, Inc, a company focused on keeping its clients’ networks and data secure via secure network design and implementation, security administration, security policies and compliance, network auditing, and data forensics. Mr. Salustro has conducted seminars on ethical hacking for the Medical Users Software Exchange (MUSE), and HIPAA and PKI for the Mass Health Association (MHA), and Data Privacy for Lorman Education Services. Mr. Salustro’s product security certifications include CISSP, McAfee, Juniper, Check Point, RSA, Aladdin, Access Data, and Palo Alto Networks. Mr. Salustro received a Bachelor of Science degree in 1992 from Brown University and has been a CISSP since 2002.
